You are solely responsible for any activity of your account.

4. Liability for Content provided by third parties

The authors and/or owners are solely liable for the content, the terms of use and the privacy policies of these games/animations.
5. Intellectual Property Rights

All the content provided and shown by Hentai-Gamer.com, except all user uploads (defined in "User Uploads"),
including animations, graphics, videos, photos, scripts, software, text, sounds, features, trademarks,
logos and the like („site content“) are owned by Hentai-Gamer.com.
All this site content is subject to copyright and other intellectual property rights under United States.
The site content is provided to you for your personal use only. You are not allowed to reproduce, copy, distribute, display, sell, license, or otherwise exploit the site content, without the permission of Hentai-Gamer.com.
6. User Uploads

Hentai-Gamer.com allows the publishing, sharing and hosting of games, animations, videos and text by the registered users ("User Uploads"). The user is solely responsible for his or hers User Uploads and the consequences of publishing such User Uploads. The user has to agree the Upload Agreement (defined below), if he or she publishes a User Upload. Hentai-Gamer.com will delete all User Uploads which violate any of the terms in the Upload Agreement.
7. Upload Agreement

THIS AGREEMENT IS MADE AND BETWEEN "HENTAI-GAMER.COM",
AND YOU ("DEVELOPER"), THE DEVELOPER OF AN ONLINE GAME.

a) Ownership

Developer shall retain all right, title, and interest in and to any games or materials
that the Developer uploads to the website Hentai-Gamer.com ("Developer Uploads").

b) License

The Developer hereby grants to Hentai-Gamer.com a worldwide, non-exclusive, sublicensable right and license to
(I) use, distribute, display, publicly perform, deliver, market, and promote Developer Uploads through the Hentai-Gamer.com website, and
(II) to develop, create, implement, and/or distribute modifications or derivative works from Developer Uploads as necessary in order to incorporate Developer Uploads in the Hentai-Gamer.com website.

c) License Termination

The license granted by Developer to Hentai-Gamer.com can be terminated
by Developer by sending an email at "admin[at]hentai-gamer[dot]com".
Within 21 days of a receipt of a termination request, Hentai-Gamer.com shall make
commercially reasonable efforts to remove the Developer Uploads from the Hentai-Gamer.com website,
to delete the copies of Developer Uploads on Hentai-Gamer.com servers and other hardware that is not available to the general public. Hentai-Gamer.com will not be responsible for removing cached copies of the Developer Uploads that may be made by third parties on their own servers, computers, or other hardware.

d) Developer Warranties

The Developer warrants that:
(I) Developer has the right to grant the license described in this Agreement;
(II) the Developer Uploads, including code, visual, and musical elements do not infringe on the rights of any third party, including any copyright, trademark, patent, trade secret or other intellectual property right, or any right of privacy or publicity;
(II) the Developer Uploads do not contain any viruses, corrupted files, backdoors, or any other similar software or programs that may adversely affect end users of the Developer Uploads or the operation on the Hentai-Gamer.com website;
(IV) the Developer Uploads do not contain falsehoods or misrepresentations or content that could give rise to a criminal offense, civil liability, violate any law, or is otherwise inappropriate;
(V) the Developer Uploads are no third party affiliate-games or the like;
(VI) THE DEVELOPER UPLOADS DO NOT CONTAIN ANY ILLEGAL POROGRAPHY (IF SO, THE DEVELOPER MAY BE REPORTED BY US TO THE AUTHORITIES!); and
(VII) Developer's entry into this Agreement does not violate any laws, rules, or regulations which govern Developer or constitute a breach, event of default, or violation of any agreement by which Developer is bound.

e) Third Party Ads

The Developer is allowed to use third party ads through hard links and banners in Developer Uploads, if these ads are displayed in a user friendly way. Automatically forwarding ads, pop ups, popunders, or the like are not allowed.

f) Publishing through Third Parties

By checking "Allow Distribution" the Developer gives third parties a worldwide, non-exclusive, sublicensable right and license to use, distribute, display, publicly perform, deliver, and promote the Developer Uploads on their websites.
Hentai-Gamer.com is not responsible for any misuse or termination of these licenses.

g) Waiver

Hentai-Gamer.com makes no warranties, assumes no liability or responsibility for,
(I) the availability, accuracy or completeness of the Hentai-Gamer.com website;
(II) any errors, mistakes, or inaccuracies of the Developer Uploads incorporated into the Hentai-Gamer.com website;
(III) any unlawful copying of the Developer Uploads, use or unauthorized access to the Developers Upload on the Hentai-Gamer.com website;
(IV) any cessation or interruption of transmission from or to the Hentai-Gamer.com website;
(V) actions or communications of Hentai-Gamer.com website users; and
(VI) any viruses, bugs, or the like which may be transmitted to or through the Hentai-Gamer.com website.
Further shall Hentai-Gamer.com has the right to delete Developer Uploads, without naming any reasons to the Developer.

h) Limitation of Liability

Hentai-Gamer.com shall not be liable, whether in contract, or in any other form of action, for any consequential, exemplary, special, indirect, incidental, or punitive damages arising out of or in connection with this agreement or its performance or failure to perform hereunder. In no event shall Hentai-Gamer.com's liability to developer for damages exceed 10.00 (ten) USD.

i) Legal Construction; Interpretation

This Agreement shall be governed in all respects by the laws of the United States of America and by the laws of the State of Florida.
Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in Florida, as applicable, for any matter arising out of or relating to this Agreement, except that in actions seeking to enforce any order or any judgment of such federal or state courts located in Florida, such personal jurisdiction shall be nonexclusive.
If one or more of the provisions of this Agreement are for any reason held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision of this Agreement; and this Agreement shall be construed as if such invalid, illegal, or unenforceable provisions had never been contained in this Agreement.
8. Warranty Disclaimer

YOU AGREE THAT YOU USE THE HENTAI-GAMER WEBSITE AT YOUR OWN RISK.
Hentai-Gamer.com makes no warranties, assumes no liability or responsibility for,
(I) the availability, accuracy or completeness of the Hentai-Gamer.com website;
(II) any errors, mistakes, or inaccuracies of the the content;
(III) any unlawful copying of the User Uploads, use or unauthorized access to the User Upload on the Hentai-Gamer.com website;
(IV) any cessation or interruption of transmission from or to the Hentai-Gamer.com website;
(V) actions or communications of Hentai-Gamer.com website users; and
(VI) any viruses, bugs, or the like which may be transmitted to or through;
the Hentai-Gamer.com website and/or by any third party websites,
9. Limitation of Liability

Hentai-Gamer.com its directors, officers, agents or employees
shall not be liable, whether in contract, or in any other form of action,
(I) for any consequential, exemplary, special, indirect, incidental, or punitive damages arising out of or in connection with this agreement or its performance or failure to perform hereunder;
(II) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website;
(III) any unauthorized access to or use of our servers and all personal information stored therein; and
(IV) any loss or damage of any kind incurred as a result of your use of any content posted otherwise made available via the Hentai-Gamer.com website, whether or not the company is advised of the possibility of such damages.

YOU SPECIFICALLY ACCEPT THAT HENTAI-GAMER.COM SHALL NOT BE LIABLE FOR USER UPLOADS OR OFFENSIVE OR ILLIGAL BEHAVIOR OF ANY THIRD PARTY AND THAT THE RISK OF DAMAGE OR HARM RESTS ENTIRELY WITH YOU.

10. Modification

Hentai-Gamer.com reserves the right to revise the terms and conditions of this Agreement at any time.
Any such revision will be binding and effective immediately upon posting of the revised Agreement on our web site. Your continued use of our site constitutes agreement to any revision of the terms and conditions of this Agreement.
11. General

You agree that:
(I) This Agreement shall be governed in all respects by the laws of the United States of America and by the laws of the State of Florida.
Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in Florida, as applicable, for any matter arising out of or relating to this Agreement, except that in actions seeking to enforce any order or any judgment of such federal or state courts located in Florida, such personal jurisdiction shall be nonexclusive.
(II) If one or more of the provisions of this Agreement are for any reason held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision of this Agreement; and this Agreement shall be construed as if such invalid, illegal, or unenforceable provisions had never been contained in this Agreement.
